Terms of Service

These Terms of Service ("Terms") govern your access to and use of HashiRun, including our website, applications, and related services (collectively, the "Service"). HashiRun ("HashiRun," "we," "us," or "our") provides a platform designed to help runners discover races, track participation, record results, and engage with the global running community.

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and HashiRun. Please read them carefully.

1. Eligibility and Acceptance

You must be at least thirteen (13) years of age to access or use HashiRun. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements and that you have the legal capacity to enter into these Terms.

If you are accessing the Service on behalf of an organization, team, or other entity, you represent that you are authorized to bind that entity to these Terms, and these Terms will apply to that entity.

2. Account Registration and Security

To access certain features of the Service, you must create an account. When registering, you agree to provide accurate, current, and complete information and to keep such information up to date.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

HashiRun is not responsible for any loss or damage arising from your failure to safeguard your account credentials.

If you create an account, HashiRun provides a way to request account deletion from within the app or by contacting us, subject to limited retention described in our Privacy Policy.

3. Use of the Service

HashiRun grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

You agree to use the Service only for lawful purposes and in accordance with all applicable laws, regulations, and community guidelines.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, including features, content, or availability.

4. User Content

The Service allows you to submit, post, and share content, including race participation data, training activity, reviews, ratings, comments, notes, spectator cheer messages, VIP messages, votes, photos, lost-and-found reports, and other materials ("User Content").

You retain ownership of your User Content. However, by submitting User Content, you grant HashiRun a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, adapt for formatting or accessibility, and use such content solely for the purpose of operating, protecting, moderating, improving, and promoting the Service.

You represent and warrant that you have all necessary rights to submit User Content and that such content does not violate any laws or infringe the rights of any third party.

Spectator cheer messages, VIP spectator messages, photos, race reviews, comments, found-report messages, and similar contributions are User Content. You are responsible for what you submit and agree not to submit content that is harassing, hateful, threatening, sexually explicit, invasive of privacy, misleading, unlawful, spammy, or otherwise harmful to other users or the running community.

5. Public and Community Features

HashiRun includes social and community features. Certain User Content, such as public Race Diaries, race participation, reviews, and ratings, may be visible to other users and the public.

You acknowledge that any User Content you make public may be viewed, shared, and indexed by others, and that HashiRun cannot control how third parties use such content.

HashiRun may review, remove, hide, filter, or restrict User Content, spectator links, or accounts when we believe content violates these Terms, creates a safety or privacy concern, or may expose HashiRun, users, race organizers, or the public to harm. To report content or behavior, contact support@hashirun.com. We may also provide in-app or web-based reporting controls where available.

6. Acceptable Use Policy

You agree not to engage in any activity that interferes with or disrupts the Service or the servers and networks connected to the Service.

Without limitation, you agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose
• Harass, threaten, abuse, or harm other users
• Post false, misleading, or deceptive information
• Impersonate another person or entity
• Share another person's private location, contact, health, or identity information without permission
• Interfere with, stalk, or misuse live spectator tracking or messaging features
• Upload or share sexually explicit, hateful, violent, or abusive content
• Use cheers, comments, photos, or found-report messages to spam, phish, or solicit users
• Attempt to gain unauthorized access to accounts or systems
• Upload malware, viruses, or malicious code
• Scrape, harvest, or collect data without permission
• Use the Service to facilitate emergency response, surveillance, gambling, or illegal activity

We reserve the right to investigate and take appropriate action against any violations of these rules, including removing content or terminating accounts.

7. Health and Fitness Disclaimer

HashiRun provides informational, tracking, and organizational tools only. We do not provide medical, health, or fitness advice, nor do we guarantee the accuracy of race data, training data, results, location, estimates, or user-generated content.

Running and athletic activities carry inherent risks. You acknowledge that participation in races and training activities is undertaken at your own risk. You are solely responsible for consulting qualified professionals regarding your health and fitness decisions.

HashiRun live tracking, spectator maps, audio updates, competitive mode, and workout metrics are provided for convenience and entertainment. They may be delayed, unavailable, inaccurate, or interrupted because of device sensors, GPS, battery state, wireless service, Bluetooth routing, network conditions, or third party services. Do not rely on HashiRun for emergency response, medical decisions, official race timing, or personal safety monitoring.

8. Live Tracking, Location, and Spectator Features

When you enable race or training spectator features, you authorize HashiRun to process and display supported location, route, progress, and workout information to people who can access the spectator link or related in-app experience.

You are responsible for choosing when to enable live tracking, who receives spectator links, and whether to use map exclusion or privacy features. You should not share spectator links with people you do not want to see your activity.

Spectator cheers, VIP messages, and audio summaries are optional communication features. HashiRun may limit, disable, remove, or moderate these features to protect users, reduce abuse, or maintain Service reliability.

9. Purchases, Subscriptions, and App Store Terms

Certain HashiRun features may require a paid subscription, race pack, credit, or other purchase. Purchases made in the iOS app are processed by Apple and are subject to Apple's App Store terms, payment rules, refund processes, and subscription management settings.

Subscriptions renew automatically unless canceled through your Apple account settings at least 24 hours before the end of the current subscription period, or as otherwise disclosed by Apple at purchase. Apple may charge your selected payment method for renewal within the period disclosed by Apple. You can manage or cancel subscriptions in your Apple ID subscription settings.

Subscription benefits remain available while the subscription is active, during any Apple billing grace period that applies, and otherwise as required by Apple or applicable law. Benefits may change over time as the Service evolves. Race packs, promo codes, gift purchases, and credits may be subject to feature-specific limits displayed at purchase or redemption.

Apple handles App Store refunds according to Apple's refund process. HashiRun does not receive your full payment-card details and cannot modify Apple account billing settings for you. If an in-app purchase is configured but temporarily unavailable or not visible during App Review, we will explain that in App Review notes.

These Terms do not limit any rights you may have under Apple's App Store terms, the Apple Media Services Terms and Conditions, or any standard Apple end-user license terms that apply to apps downloaded through the App Store.

10. Intellectual Property

All content and materials provided by HashiRun, including software, design, logos, trademarks, text, graphics, and other assets, are owned by or licensed to HashiRun and are protected by intellectual property laws.

Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written consent.

11. Third-Party Services and Links

The Service may contain links to third-party websites, services, or resources. These links are provided for convenience only and do not constitute endorsement.

HashiRun is not responsible for the content, policies, or practices of third-party services. Your interactions with third-party services are governed by their respective terms and policies.

If you connect Apple Health, Strava, Apple Push Notification service, Apple Live Activities, or another supported third-party service, you authorize HashiRun to exchange the activity, workout, notification, entitlement, and account information needed to provide that integration. You may need to manage or revoke access in HashiRun, iOS settings, Apple account settings, or the third-party service's own settings.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct that may harm the Service or other users.

You may terminate your account at any time by following the account deletion process or contacting us.

Deleting your HashiRun account does not automatically cancel subscriptions or other purchases managed by Apple. You must manage or cancel Apple subscriptions through your Apple account settings.

Account deletion may remove your profile and account access from the active Service while HashiRun retains limited backend records where needed for legal, financial, security, fraud-prevention, audit, support, App Store transaction, or integrity purposes, as described in the Privacy Policy.

13. Limitation of Liability

To the fullest extent permitted by law, HashiRun shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill.

HashiRun's total liability for any claims arising out of or relating to the Service shall not exceed the amount you paid to use the Service, if any, during the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless HashiRun, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction in which HashiRun operates, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved exclusively in the courts of that jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. When changes are made, we will update the effective date and post the revised Terms on this page.

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
